Booking:
At the time of booking, a $50 non-refundable deposit is required to secure your appointment date and time. Appointments made without deposit may not be honored and are subject to cancellation. Payment of the deposit is required at the time of booking and has a 24-hour grace period. Deposits that are not paid within 24 hours of setting an appointment may not be honored and subjects the appointment to cancellation. Payment of the deposit acts as an agreement to all of the Brii Creative Visuals policies. Collaborations/Creative Endeavors booked with no monetary gain (Free work) give Brii Creative Visuals ALL rights to photos/footage taken and can be used however/whenever she see’s fit.
Payment:
Sessions must be paid in full prior to shoot date or immediately after the shoot via Cash, Zelle, Apple Pay or the invoice link. Checks are not accepted. An additional $20 surcharge will be added on all sessions where client is beyond 15 minutes late. Session end times will not be extended to accommodate client lateness.
Cooperation:
Both the Client and the Photographer/Videographer agree to communicate and collaborate to achieve the best possible photographic results under this contract. The Photographer/Videographer is not responsible for key shots missed due to the lateness of the Client or interference from guests (e.g., guests blocking the shot with their phones).
Schedule:
The Photographer/Videogrpaher’s shooting schedule, working style, and experience are designed to produce a high-quality collection of event photographs/footage. Punctuality and cooperation from all parties are essential for achieving the best results. In cases where the photoshoot/event does not run on schedule (e.g., significant delays caused by guests or unforeseen circumstances), the Photographer/Videographer will make every effort to adapt, but the original scope of photography/videography cannot be guaranteed.
Copyright & Usage Rights:
* Photographer/Videographer Rights: Brii Creative Visuals retains copyright to all images and may use images for portfolio and promotional purposes (Instagram/TikTok/Website and etc).
* Client Usage: The Client is granted a personal use license to print and share images on social media. Images may not be sold or used for commercial gain without written consent.
Model Release:
The Client grants the Photographer/Videographer and their legal representatives, heirs, and assigns the irrevocable and unrestricted right to use photoshoot/event images for promotional, editorial, competition, or advertising purposes. This includes the right to alter images as needed. The Client releases the Photographer/Videographer from any liability or claims in connection with image/video usage.
Cancellation:
Neither party shall be held liable for delays or non-performance caused by conditions beyond their control, including but not limited to acts of God (e.g., natural disasters), fires, government restrictions, wars, terrorist acts, insurrections, or other unforeseen emergencies. If Brii Creative Visuals cannot perform this contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to illness or emergency, then the Photographer/Videographer shall return the retainer fee to the client. This shall also apply in the event that photographic/footage materials are damaged in processing, lost through camera or other media malfunction, lost in mail or otherwise lost or damaged without fault on the part of the Photographer/Videographer. In the event Brii Creative Visuals fails for any other reason, Brii Creative Visuals shall not be liable for any amount in excess of all monies paid.
Image Policy:
Image proofs are returned to client within 1-4 business days from when they are taken. Turnaround time may vary depending on the volume of business experienced at the time images are being edited. Normal turnaround time for edited images are 7-14 business days from when the date the client selects images to be edited.
Video Policy:
Highlight recap videos are edited in Brii Creative Visuals' signature cinematic style. Unless otherwise stated in the service package, event videos include a 60–90 second highlight recap. Video length may vary slightly depending on the event and the quality and quantity of footage captured.
Raw video footage is not included with any package and remains the property of Brii Creative Visuals. Raw footage may be purchased separately, when available, for an additional fee.
The Photographer/Videographer maintains full creative discretion regarding shot selection, editing style, music choice, color grading, pacing, transitions, and the final presentation of the video. While every effort is made to capture all important moments, Brii Creative Visuals cannot guarantee every requested shot due to event timing, lighting conditions, venue restrictions, guest interference, or other circumstances beyond the Photographer/Videographer's control.
Video turnaround time is typically 7–14 business days for highlight recap videos unless otherwise specified in writing. During peak seasons or periods of high booking volume, delivery times may be extended. Clients will be notified if additional editing time is needed.
One round of minor revisions is included with each highlight video. Additional revisions or significant editing changes requested after delivery may incur an additional editing fee.
